How US Import Tariffs Are Calculated

US import duties are built from multiple overlapping tariff layers. Each layer is authorized by a different law and administered independently. The total duty you pay is the sum of all applicable layers โ€” this calculator handles the stacking automatically.

Section 301 Forced-Labor Tariff (10% / 12.5% โ€” replaced Section 122 on July 24, 2026)

The base reciprocal layer for countries without a separate deal is now the Section 301 forced-labor tariff. Its predecessor, the flat 10% Section 122 reciprocal tariff (Trade Act of 1974), took effect February 24, 2026 โ€” replacing the IEEPA tariffs the Supreme Court struck down on February 20 โ€” but Section 122 carries a 150-day limit and expired on July 24, 2026. The same day it was replaced by the Section 301 forced-labor tariff in FR Doc. 2026-15181, 91 FR 47318 (the HTS instrument) and memorandum FR Doc. 2026-15274. Some economies are a 10% or 12.5% additive duty. Japan, Korea, and Switzerland are a 12.5% net of Column 1. Taiwan and ordinary EU goods are a 10% net of Column 1. Where Column 1 is already at the ceiling, the additional duty is 0. MFN (General) basis - Special-claim/AVE not modelled. exemption lists in note 52/Annex II not modelled.

EU ordinary goods (10% net โ€” effective July 24, 2026)

Ordinary EU-origin goods pay a 10% net of Column 1 (note 52(k), headings 9903.05.38โ€“.39). 15% remains only in lieu of Section 232 for autos, qualifying semiconductor articles, and drones. Steel and aluminum stay at Section 232 rates. Aircraft headings 8802 and 8803 are MFN-only. Ordinary 8541/8542 goods are not a heading-wide semiconductor tariff.

Section 232 Surcharges

Section 232 authorizes tariffs on imports that threaten national security. Since the April 6, 2026 restructure, articles made wholly of steel, aluminum, or copper face 50%, while derivative products substantially made of those metals face 25% โ€” both applied to the full customs value. Autos and auto parts face 25%. Ordinary 8541/8542 goods are not a heading-wide 25% semiconductor tariff. Note 39(b) limits heading 9903.79.01 to qualifying logic ICs in 8471.50, 8471.80, and 8473.30. qualifying status unknown - broker to confirm when those thresholds are not on the entry. Lumber is a separate action. These metal and auto rates were NOT affected by the SCOTUS ruling. (This calculator applies the 50% headline rate for covered metals.)

Section 301 (China-specific)

Section 301 authorizes additional duties on Chinese imports for unfair trade practices: 7.5% to 100% depending on the product list. Chinese EVs face 100%, solar panels 50%, EV batteries 25%. These stack on top of the forced-labor tariff โ€” see the China tariff rate guide for the 37.5% effective math on a $10,000 electronics shipment.

MFN Base + Trade Agreements

Every product also has a Most Favored Nation (MFN) base rate from the HTS schedule โ€” ranging from 0% on many electronics to over 20% on certain textiles and footwear. USMCA and KORUS can reduce or eliminate the MFN. Section 301 stacks on top, and Section 232 applies to metals and autos โ€” but the forced-labor tariff does NOT stack on the metal content of a Section 232 article, and USMCA-qualifying goods are exempt from the base reciprocal layer.

One offset most importers miss: if any of these goods get re-exported, destroyed, or built into exported products, up to 99% of eligible duties โ€” including Section 301, but NOT Section 232 (excluded from drawback by proclamation since 2018) โ€” is recoverable through duty drawback, retroactive 5 years. Estimate yours with the duty drawback calculator.

Frequently Asked Questions

How accurate is this calculator?
The calculator uses current published tariff rates and provides estimates for general product categories. Actual duties depend on the specific 10-digit HTS classification of your goods. For binding determinations, consult a licensed customs broker.
What tariff layers are included?
MFN base rates, the Section 301 forced-labor tariff (10%, or 12.5% for a 46-economy tier โ€” this replaced the 10% Section 122 reciprocal tariff when it expired on July 24, 2026), the EU deal rate (10% net of Column 1 for ordinary goods (15% only in lieu of Section 232 for autos, qualifying semiconductor articles, and drones) ceiling, effective July 1, 2026), Section 232 surcharges (50% steel/aluminum; passenger vehicles in note 33(b) are Germany 15%, Japan 15%, and South Korea 15% ordinary duty when Column 1 is under 15%, the UK in-quota rate is United Kingdom 10% (heading 9903.94.31, 100,000-vehicle quota, not tracked here), and other listed origins pay Column 1 + 25% (Mexico 27.5%, China 52.5%, Australia 27.5%)), Section 301 (China-specific 7.5-100%), and trade agreement preferential rates (USMCA, KORUS, UK-EPD).
How much does a tariff cost in 2026?
For most countries the total tariff cost is the MFN base rate plus the 10% Section 301 forced-labor tariff (12.5% for a 46-economy tier), which replaced the expired Section 122 reciprocal tariff on July 24, 2026 โ€” so $10,000 of goods with a 0% MFN rate owes about $1,000. EU goods pay a flat 15% ceiling as of July 1, 2026. Chinese goods add Section 301 China duties of 7.5-100% on top. Steel, aluminum, and copper articles pay 50% under Section 232 regardless of origin (the base reciprocal layer does not stack on the metal content).
Do I need to pay tariffs on small shipments?
Yes. The $800 Section 321 de minimis exemption has been suspended for all countries (China and Hong Kong since May 2, 2025; all other countries since August 29, 2025). Commercial shipments of any value now owe applicable duties. Returning travelers still have a separate personal exemption โ€” see the traveler duty-free guide.
Did I overpay duties in 2025?
If you paid IEEPA reciprocal duties between April 2025 and February 2026, that IEEPA layer is refundable through CAPE. CBP's September 15, 2026 update put $134.7B accepted and $122B certified to Treasury. Start with how to claim an IEEPA refund, the tariff-refunds hub, and CAPE refund status. This calculator estimates current duty, not your refund.
How are US import duties calculated?
US import duty is the sum of applicable layers on the customs value: the HTS MFN base rate, plus the origin layer (Section 301 forced-labor 10%/12.5%, or the EU 10% net of Column 1 for ordinary goods (15% only in lieu of Section 232 for autos, qualifying semiconductor articles, and drones) ceiling), plus Section 232 on covered metals/autos and Section 301 on covered Chinese goods. This calculator stacks those layers from the country and HTS (or category) you enter.
Can I look up an HTS code in this customs duty calculator?
Yes. The default mode is a product / HTS lookup โ€” type a product name or a partial code (for example 6109 or 8471) and pick the matching line. That lookup uses a curated static snapshot of USITC general rates (country layers last verified 2026-10-23), not a live USITC feed. This page then stacks 2026 country layers on top. Use the HTS finder to browse lines by chapter, and confirm a binding rate at https://hts.usitc.gov/.
Does this include freight and a landed cost?
Duty is calculated first on the product value and the HTS code or category you enter. Open โ€œAdd freight and feesโ€ to type your freight estimate, insurance, and other fees such as brokerage. The result then adds an estimated Merchandise Processing Fee (FY2026 formal floor $33.58, ceiling $651.50) and, if you mark the shipment as ocean, an estimated Harbor Maintenance Fee at 0.125%. The total is an estimate, not a CBP invoice or a freight quote.
