A plain-English status of CBP’s CAPE process — the system paying back the IEEPA tariffs the Supreme Court struck down. Which phases are open, how much has been paid, and how to check your own refund.

Status by phase
Open since April 2026. Refunds of IEEPA duties on entries not yet finally liquidated are being processed and disbursed to the Importer of Record (or its designated party).
Open since June 29, 2026. Extends CAPE to reconciliation entries and entries carrying antidumping/countervailing duties tied to the struck-down IEEPA tariffs.
On track for late July 2026. On July 17, 2026 the U.S. Court of International Trade ordered CBP to process refunds for finally-liquidated entries. Refunds in this phase generally require court-approved access — importers typically must have filed suit at the CIT to reach these entries. If your entries are already finally liquidated, review whether you need to file.
CBP has indicated it is building CAPE functionality to handle entries with open protests. Not yet live.
How to check your CAPE refund status
- Refunds are consolidated and issued to the Importer of Record (IOR), or to a party the IOR designates to receive them.
- Enroll for electronic refund in the ACE Portal so CBP can deposit refunds directly rather than mailing checks.
- Track your entries’ liquidation status in ACE — that determines which phase they fall under (Phase 1/2 vs. finally-liquidated Phase 3).
- For Phase 3 finally-liquidated entries, confirm whether you need court-approved access before those refunds can reach you — do you need to sue?
