IEEPA Tariffs

IEEPA tariffs were the 'reciprocal' import tariffs imposed in 2025 under the International Emergency Economic Powers Act, layered on top of existing duties for most countries. The Supreme Court struck them down as unlawful on February 20, 2026, ruling the president lacked IEEPA authority to impose them — which opened an estimated $166 billion refund pool for importers who paid the IEEPA layer between April 2025 and February 2026. Example: an importer who paid a 20% IEEPA reciprocal rate on $1M of goods overpaid roughly $200,000 that is now potentially refundable through the CBP reliquidation (CAPE) process. It matters because if you imported during that window, the IEEPA portion of your duty is likely recoverable — separate from Section 232/301, which were not struck down.
