CAPE
CAPE refers to the CBP mechanism for reclaiming IEEPA tariff overpayments after the Supreme Court struck those tariffs down — entries that paid the unlawful IEEPA layer are reliquidated in phases and the overpaid duty refunded from the ~$166B pool. Filing a CAPE claim requires the entry records (CBP Form 7501, liquidation dates) proving the IEEPA amount paid during April 2025-February 2026. Example: an importer whose entries paid a 20% IEEPA reciprocal rate files through the CAPE process to recover that layer. It matters because CAPE is the path from 'the tariff was ruled unlawful' to actual money back — and it runs on a deadline-sensitive, phased schedule.
